The Biden administration has officially withdrawn rules that require workers in large corporations to be vaccinated or face regular COVID testing requirements.
The Occupational Safety and Health Administration confirmed the withdrawal on Tuesday. However, officials said they still strongly encourage workers to be vaccinated.
In early November, OSHA announced a vaccine or testing obligation for companies with at least 100 employees. Rule __, which would have affected more than 80 million US workers, was originally set to take effect on January 4.
However, many states and corporate groups have challenged this rule in court. On January 13, the Supreme Court canceled the plan. In a 6-3 decision, a conservative majority of courts concluded that OSHA exceeded its authority.
“OSHA has never imposed such an obligation. There is no parliament,” the majority of the courts wrote. “Sure, Congress has enacted important legislation to deal with the COVID-19 pandemic, but refused to enact measures similar to those promulgated here by OSHA.”
The judge left the vaccine obligations to federal Medicare or Medicaid-funded healthcare providers. The rule affects 1.04 million workers.
OSHA has shown that the rule may be returned in some way. It’s no longer a enforceable standard, but it remains the proposed rule, OSHA said. Meanwhile, authorities said they would prioritize their healthcare obligations.
