Epic Games has filed a notice appealing to a federal judge’s decision in a proceeding alleging that Apple has an illegal monopoly that hinders competition.
The maker of the popular Fortnite video game said it would rule in San Francisco’s Ninth Circuit Court of Appeals in a court filed Sunday.
In a 185-page ruling on Friday, Judge Yvonne Gonzalez Rogers of the U.S. District Court dismantles Apple’s advantage of a competitive barricade guarding the tightly-operated iPhone App Store. But rejected Epic’s claim that Apple had monopolized it.
Epic’s notice of appeal stated that it would appeal the final decision to “and all orders leading to or making that decision.”
The ruling continues to scrape Apple’s so-called “walled garden” around its crown jewels, iPhone, and its app store without completely knocking it down.
The decision also provided Apple with some evidence. The judge did not brand Apple as a monopoly or demand that competitors be able to offer apps for the iPhone, iPad, and iPod.
