Bismarck, North Dakota (AP) —Federal and state lawyers will meet next week in North Dakota to negotiate a monetary settlement alleging that the state has spent cracking down on protests against the Dakota Access Oil Pipeline.

North Dakota filed a proceeding against the US Army Corps of Engineers in 2019 seeking damages of more than $ 38 million. The months-long pipeline protested almost five years ago.

State Attorney General Wayne Stenehem and other state lawyers will meet with corps and Justice Department lawyers in federal court in Bismarck on September 16. US Justice of the Peace Alice Seneschal presides over private negotiations.

“We’ll see on the 16th if they’re serious about calming down,” Stenehjem said.

According to Stenehem, this is the first roundtable discussion to consider a settlement with state and federal lawyers. The federal judge dealing with the case “strongly proposed” the negotiations, he said.

If the settlement cannot be reached, the trial will be set on May 1, 2023.

In early 2016 and early 2017, thousands of pipeline opponents gathered in southern North Dakota, camping on federal lands and often clashing with police. Hundreds of people were arrested for six months.
