A trio convicted of murdering Amado Arbury. What now?

Immediately after Travis McMichael shot Arbury deadly on February 23, 2020, his father, Greg McMichael, told police how the pair was armed, chasing a young black man and chasing him. After a 13-day trial at Glynn County Hall on the Georgia coast, a disproportionate white jury convicted three white men for murder. Each man was also convicted for a lower fee.

How much did each person get convicted?

With nine indictments, all three were all three with one malicious murder, four felony murders, two weighted assaults, one false imprisonment, and one attempted felony (in this case false). I was charged with (confinement).

Travis McMichael was convicted of all nine charges. Greg McMichael was convicted of all charges except malicious murder. Brian was convicted of two felony murders, one weighted assault, one imprisonment and one attempted felony.

How much prison time do they face?

Both malicious and felony murder convictions minimize life imprisonment. The judge decides if there is a possibility of parole. Even if parole is recognized, a person convicted of murder must serve for 30 years before qualifying. Convictions for multiple murders are merged for the purpose of the judgment.

A murder in Georgia could also be sentenced to death if the murder meets certain criteria and the prosecutor chooses to seek the death penalty. The prosecutor in this case did not.

Each count of exacerbated assaults is subject to imprisonment of at least one year and up to 20 years. Imprisonment is sentenced to 1 to 10 years in prison.

When will they be sentenced?

It’s not clear yet. Judge Timothy Walmsley of the Superior Court sets the decision date.

Do you have an appeal?

Ron Carlson, an emeritus professor at the University of Georgia, said the appeal was almost certain in this case.

He said one of the possible grounds for appeal could be to exclude certain evidence from the trial. Attorneys sought to present Arbury’s criminal record, records of his mental health, and evidence of the fact that he was on probation. They also wanted to have an expert in the use of power testify. However, the judge ruled against admitting any of the evidence.

“They would argue that the relevant evidence useful for defense was excluded by the judge, and that was a mistake,” Carlson said.

Appeals lawyers may also scrutinize the writing records and jury instructions, talk to the jury, and then find other reasons for the appeal.

Are federal crimes pending yet?

Yes. McMichael’s and Brian are still facing federal crime.

A few months before the three were tried for state murder, a federal grand jury in April charged them with hate crimes. This is a completely different case that is unaffected by the outcome of the state trial.

Judge Lisa Godbey Wood of the US District Court plans to select a jury in a federal trial starting February 7. All three men have been charged with one charge of interfering with citizenship and attempted kidnapping. McMichaels was also charged with using, carrying and swinging firearms during violent crimes.

The federal indictment says the man targeted Arbury because he was black.
