The Justice Department has sued Texas over a new state law banning most abortions, claiming it was enacted “openly ignoring the Constitution.”
A proceeding filed in a federal court in Texas on Thursday called on a federal judge to declare the law invalid and “prohibit its enforcement and protect the rights infringed by Texas.”
Texas law, known as SB8, prohibits abortion once medical professionals are able to detect heart activity. It’s usually about 6 weeks before you know you’re pregnant. Courts have prevented other states from imposing similar restrictions, but Texas law is very different because it entrusts enforcement to civilians through civil proceedings rather than criminal prosecutors.
Not only from the White House, President Joe Biden said the law was “almost non-American,” but also from Congressional Democrats who wanted Attorney General Merrick Garland to take action. There was pressure on the Justice Department. Earlier this week, Garland vowed that the Department of Justice would enforce federal law known as freedom of access to clinic admissions.
The law, commonly known as the FACE Act, usually prohibits physically blocking access to abortion clinics. Property damage at abortion clinics and other reproductive medical centers is also prohibited.
