The proceedings do not specify the monetary damages sought, nor do they mention any particular safety breach.
But another lawyer for the family, Larry Goldhilsh, said these details will be identified in the coming weeks, including dysfunctional door springs and windows that couldn’t be opened.
Residents of the apartment rushed away and left the front door open behind when the fire began.
The spring-loaded hinges that were supposed to close the door automatically didn’t work. The second door, which remained open in the atrium of the upper staircase, acted as a flue and sucked smoke upwards.
Fire investigators said the front door of the apartment and the doors on the 15th floor had to be closed automatically to control the spreading smoke, but the doors remained fully open. It was not clear if the door had mechanically failed or was manually disabled.
